29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Anthony Davis dba Davis Contracting, LLC at 3276 Jim Street, Rapid City, SD 57703: On or about and at times prior to May 22, 2024, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a multi-family residential property without the use of a fall protection system, a lack of use of eye protection while using pneumatic nail guns, and a lack of training documentation.  This condition exposed employees to a variety of hazards while working on site.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)Anthony Davis dba Davis Contracting, LLC at 3276 Jim Street, Rapid City, SD 57703: On or about and at times prior to May 22, 2024, the exposing employer did not ensure that each employee that was installing floor joists on a multi-family residential property with the use of a pneumatic nail guns were protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)Anthony Davis dba Davis Contracting, LLC at 3276 Jim Street, Rapid City, SD 57703: On or about and at times prior to May 22, 2024, the exposing employer did not ensure that employees were protected from falls while conducting framing and floor joist installation operations on a multi-family residential structure. This condition exposed the employees to fall hazards greater than six feet.
