29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): On or about March 13, 2024, employees were exposed to a fall of approximately 20 feet while performing roofing work on a low sloped residential home located at 8805 Denison Ave., Cleveland, OH 44102. The employer did not ensure the employees working on all areas of the roof were utilizing any form of fall protection. An employee fell while attempting to install plywood on the roof. Molina Flores Carpet LLC. dba Molina Flores Carpet and Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 1926.501(b)(13), which was contained in OSHA inspection number 1588207, citation number 01, item number 01 and was affirmed as a final order on May 20, 2022, with respect to a workplace located at 7718 Broadview Road, Seven Hills, OH 44131.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye: On March 13, 2024, the employer did not report the in-patient hospitalization of an employee who sustained injuries after a fall of approximately 20 feet from a residential roof. The employee remains paralyzed and hospitalized due to those work-related injuries. OSHA was not notified until May 16, 2024, through the OSHA complaint system.
