As a result, employees were exposed to fall hazards from a height of 9 feet 5 inches due to improperly set up ladders, lack of fall protection, and lack of fall protection training.

29 CFR 1926.502(a)(2):Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. a) On May 24, 2024, the employer did not provide and install the required fall protection systems for employees working on the roof at Benihanas 50 Tri-County Parkway, Cincinnati, Ohio. Employees began work without any fall protection systems in place, exposing them to fall hazards from a height of 9 feet 5 inches.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a) On May 24, 2024, the employer did not provide a training program for employees who were exposed to fall hazards while working on the roof at Benihanas 50 Tri-County Parkway, Cincinnati, Ohio. Employees were not trained to recognize the hazards of falling or in the procedures to minimize these hazards, resulting in exposure to fall hazards from a height of 9 feet 5 inches.

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) On May 24, 2024, the employer did not ensure that the ladder side rails extended at least 3 feet above the upper landing surface to which the ladder was used to gain access at Benihana's at 50 Tri-County Parkway, Cincinnati, Ohio. The ladders in use did not extend the required distance above the roofline, exposing employees to a fall hazard of 9 feet 5 inches while accessing and working on the roof.

29 CFR 1926.1053(b)(5)(i):Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support). a) On May 24, 2024, the employer did not ensure that ladders being used by employees for roofing work at Benihana's at 50 Tri-County Parkway, Cincinnati, Ohio, were set up at an angle equal to one-quarter of the working length (0.25). The ladders were being used at a setup ratio exceeding the required ratio of non-self-supporting ladders by a ratio of 3.71, exposing employees to a fall hazard of 9 feet 5 inches to the hard ground below.
