29 CFR 1926.652(g)(2): Additional requirement for shield systems used in trench excavations. Excavations of earth material to a level not greater than 2 feet (.61 m) below the bottom of a shield shall be permitted, but only if the shield is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the shield. a) On May 23, 2024, the employer permitted its employees to enter the trench and perform work when the earth material was excavated approximately 3 feet below the bottom of the support system. No abatement certification or documentation is required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): a) On May 23, 2024, employees were not adequately protected from the hazards of cave-in while working in a trench measuring approximately 7 feet in depth. Di Meo Brothers, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1523939, citation number 1, item number 1 and was affirmed as a final order on July 6, 2021, with respect to a workplace located at N Huron St & N Verde Dr, Arlington Height, Illinois 60004. Di Meo Brothers, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1459182, citation number 2, item number 1 and was affirmed as a final order on May 18, 2020, with respect to a workplace located at 600 W.
