29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) 2240 Speer Boulevard., CO 80211: On or about May 23, 2024, and at times prior, employees were exposed to airborne silica while performing concrete repairs, while using chipping tools that did not have the proper engineering controls in place, to limit employee exposure to airborne silica.  b) 2240 Speer Boulevard., CO 80211: On or about May 23, 2024, and at times prior, employees were exposed to airborne silica while performing concrete repairs, while using a handheld power saw that did not have the proper engineering controls in place, to limit employee exposure to airborne silica.

29 CFR 1926.1153(i)(2)(i): The employer did not ensure that each covered employee could demonstrate knowledge and understanding of at least the information contained in paragraphs (A) - (F) of this section:  a)  2240 Speer Boulevard., CO 80211: On or about May 23, 2024, and at times prior, employees were exposed to airborne silica while performing concrete repairs, while using chipping tools and powered hand saws that did not have the proper engineering controls in place, to limit employee exposure to airborne silica. The employer did not ensure employees were provided with the required information on the hazards associated with silica and the means to control these hazards.
