Employees are clearing jams regularly when the machine is in operation and the machine is not being locked and tagged out prior to clearing a jam.

29 CFR 1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation: On or about May 23, 2024, the employer failed to ensure that the N5 milk carton machine line operators were trained as authorized to apply lock out tag out when clearing jams on the machines. Employees are clearing jams regularly when the machine is in operation and the machine is not being locked and tagged out prior to clearing a jam.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about May 23, 2024, the employer did not ensure that the N5 carton line was guarded at the electric arm, chain and sprocket portion of the machine. An employee was able to reach into the hazardous area of the machine, causing a finger amputation.

29 CFR 1910.147(d)(3): All energy isolating devices that were needed to control the energy to the machine or equipment were not physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s): On or about May 23, 2024, the employer failed to ensure that the N5 milk carton machine line was locked and tagged out to isolate the electrical and pneumatic energy sources of the machine prior to employees clearing jams on the machines. The employer was previously cited for a violation of this occupational safety and health standard which was contained in OSHA Inspection#1612947, citation 1, item 3, which was affirmed as final order on 1/3/2023, with respect to the workplace located at 1000 6th Street SW, Winter Haven , FL 33880.
