29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) Claremont Business Park, Lot 2 & 3, Colorado Springs, CO 80915: On or about May 24, 2024, a Deere 245G LC excavator being used to extend an excavation was not kept at least 2 feet from the edge of the excavation. This condition exposed employees within the excavation to cave-in and crushed-by hazards.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): a) Claremont Business Park, Lots 2 & 3, Colorado Springs, CO 80915: On or about May 24, 2024, and at times prior, the employer did not ensure that the sloping of the south and east faces of the excavation were in accordance with the requirement options of this standard. Employees entered the excavation and worked adjacent to the south and east faces that were improperly sloped for Type C soil. This condition exposed employees to cave-in and struck-by hazards.
