29 CFR  1910.269(p)(4)(ii): A designated employee other than the equipment operator did not observe the approach distance to exposed lines and equipment and provide timely warnings before the minimum approach distance required by paragraph (p)(4)(i) of this section is reached, unless the employer can demonstrate that the operator can accurately determine that the minimum approach distance is being maintained:   a) Front Truck - On or about May 23, 2024, employees were exposed to electrocution hazards when an employee operating a bucket truck (License plate number: 45838NA, Model: 2020 International MV607, VIN number: 3HAEUMMN7LL442784, Altec Boom: LR7-60E70 model containing serial number 0420FF12071) did not maintain the minimum approach distance due to contacting the power lines (34.5kV phase to phase/19.9kV phase to ground).  When the line-clearance tree trimmer in the bucket of the truck approached the minimum approach distance, the second line-clearance tree trimmer working on the ground, sharpening a chain saw (STIHL M5 261) on the fender of the attached wood chipper (2018 Altec chipper model DC1317 assigned the VIN number 4HAP31513JM000172) did not provide timely warnings before the minimum approach distance was reached to the employee in the bucket.      b) Rear Truck - On or about May 23, 2024, employees were exposed to electrocution hazards when an employee operating a bucket truck (License plate number: 41306PF, Model: 2024 Freightliner M2-106, VIN number: 3ALACXFC9RDUZ7323, Altec Boom: LR8-60E70 model containing serial number 0623JF4032) did not maintain the minimum approach distance due to working approximately 6 inches from the power lines (34.5kV phase to phase/19.9kV phase to ground).   When the line-clearance tree trimmer in the bucket of the truck approached the minimum approach distance, the second line-clearance tree trimmer working on the ground, was taking a break and did not provide timely warnings before the minimum approach distance was reached to the employee in the bucket.
