29 CFR 1910.134(e)(1): Medical Evaluation. General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. (a) On or about May 28, 2024, the employer did not ensure that each employee who wore a respirator with a tight fitting facepiece received a medical evaluation to ensure the employee was able to use a respirator before the employee was fit tested or assigned to perform a job task where respirator use was required.

The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. (a) On or about May 28, 2024, the employer did not ensure that each employee who wore a respirator with a tight fitting facepiece was fit tested before performing a job task where respirator use was required.

1910.134(k)(1)(iii) How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions; 29 CFR 1910.134(g)(1)(i)(A): Use of respirators. Facepiece seal protection. The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have: Facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function. (a) On or about May 28, 2024, the employer permitted two maintenance employees with full beards to wear respirators, such as but not limited to MSA Advantage 200 half face, 3M 6000 half face and 3M 6000 full face tight fitting respirators with Organic Vapor/Acid Gas cartridges, while these employees were exposed to ChemStation 50245 Foaming Cleaner (causes severe skin and eye burns/damage) while cleaning up an unknown acidic chemical spill in the blending area. (b) On or about May 28, 2024, the employer permitted an employee with a full beard to wear a respirator, such as but not limited to MSA Advantage 200 half face, 3M 6000 half face and 3M 6000 full face tight fitting respirators with Organic Vapor/Acid Gas cartridges, while working in the blending area with ChemStation cleaning chemicals that cause respiratory irritation, severe skin and eye burns on a daily basis.

29 CFR 1910.1200(h)(1): Employee information and Training. Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. (a) On or about May 28, 2024, the employer had not provided initial information and training on hazardous chemicals in the work area at the time of initial assignment for an employee who had worked in the blending area for at least one month with ChemStation, Diversey, Univar Solutions and Ecolab cleaning chemicals that cause respiratory irritation, severe skin and eye burns and unidentified chemical ingredients for the products produced at this site.

Employee training shall include at least: The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used. (a) On or about May 28, 2024, the employer had not provided maintenance employees with training that included appropriate work practices, emergency procedures, and personal protective equipment in the event of a spill in that, employees used ChemStation 50245 Foaming Cleaner (causes severe skin and eye burns/damage) to clean up an unknown chemical spill.
