29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. At the jobsite, employees operating a Hitachi nail gun to perform installing shingles and roof vents without eye and face protection exposing him to the hazard of being struck-by flying objects.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. On or about May 24, 2024, employees who were installing shingles and vents to the roof of the house, were not wearing fall protection, exposing the employees to an unprotected fall hazard of approximately 20 feet to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: At the jobsite, employees installing shingles and roof vents without fall protection, were not provided a training program with hazard recognition and avoidance training where part of the job is to be exposed to fall hazards at a heights over 6 feet to the ground below.
