29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  Location: 114 Grand St, Croton on Hudson, NY 10520  a) On or about May 24, 2024, the employer did not develop or implement a written hazard communication program for employees who use chemicals such as, but not limited to, bonding adhesive (contains toluene, acetone, tert-Butyl acetate, methyl acetate).  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item, failure to comply will result in an additional penalty of $1,000.00 as per 29 CFR 1903.19.

29 CFR  1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:   Location: Rooftop of 114 Grand St, Croton on Hudson, NY 10520  a) On or about May 24, 2024, employees on the roof were not protected from from tripping in or stepping into or through a skylight by covers or a guardrail system erected  around the skylight.   Note: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  Location: 114 Grand St, Croton on Hudson, NY 10520  a) On or about May 24, 2024, employees were exposed to fall hazards of approximately 20 feet while using an extension ladder to access the roof to perform roof work. The side rails of the ladder did not extend at least 3 feet above the roof surface.  Note: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Location: Rooftop of 114 Grand St, Croton on Hudson, NY 10520  a) On or about May 24, 2024, employees were exposed to fall hazards of up to 25 feet while conducting roof work on a low slope commercial roof without being protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Perry Verrone, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1518211, citation number 2, item number 1 and was affirmed as a final order on March 18, 2022 , with respect to a workplace located at 32 Nob Hill Dr, Elmsford, NY 10523.  Perry Verrone, LLC was previously cited for violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1484499, citation 1, item 1,  and was affirmed as a final order on September 04, 2020, with respect to a workplace located at 69 Sherman Ave, Yonkers NY 10704.  Note: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.
