29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Facility: On or about June 12, 2024, employees conducting log-sawing operations were exposed to noise in excess of OSHA's Action Level of 85 dBA as an eight-hour time-weighted average, and the employer did not institute a continuing, effective hearing conservation program: 1) On or about June 12, 2024, a Sawyer/Take Off Man was conducting pine logs sawing operations . The employee was overexposed to continuous noise at a level of 90.2 dBA. This level of exposure is 103% of the OSHA Action Level of 85 dBA, measured as an 8 hour time weighted average. The employee was sampled for 240 minutes. Zero exposure was assumed for any unsampled time. 2) On or about June 12, 2024, a Sawyer/Take Off Man was conducting pine log sawing operations The employee was over exposed to continuous noise at a level of 87.4 dBA. This level of exposure is 1.07% of the OSHA Action Level of 85 dBA, measured as an 8 hour time weighted average. The employee was sampled for 241 minutes. Zero exposure was assumed for any unsampled time.
