29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; (ii) Communicate selection decisions to each affected employee; and (iii) Select PPE that properly fits each affected employee. National Weather Service (NWS), Raleigh: On or about 05/29/2024, the employer did not ensure that a written workplace hazard assessment for personal protective equipment (PPE) was conducted for employees engaged in activities such as, but not limited to radar repair, site maintenance, temperature sensor installations and site surveying. 29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following: National Weather Service (NWS), Raleigh: On or about 05/29/2024, the employer did not establish and implement a written hazard communication program and training for all employees who use or are exposed to hazardous materials such as, but not limited to bug spray, isopropyl alcohol, WD-40, soldering flux, lubricate oils, spray adhesives, glass cleaners and spray paints.
