29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance paragraph (b) or (c) of 29 CFR 1926.652: a) 1310 Langley Rd., Rio Grande, NJ - The employer allowed workers to work in an trench, approximately 6 feet deep, 100 feet long and 10 feet wide in Type-C Soil (approximately 86% sand/gravel), with the incorrect protective system in place for the workers working in a trench. The trench walls were benched and not sloped at an angle not steeper than one and one-half horizontal to one vertical, thus exposing the employees to cave-in hazards. This condition was observed on or about May 31, 2024. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
