29 CFR 1926.351(e):Arc welding or cutting operation(s) were not shielded by noncombustible or flame proof screens to protect employees and other persons working in the vicinity from the direct rays of the arc: a) On or about 5/22/2024 at a construction project located at 7000 Route 16, Franklinville, New York; employees welding on the 2nd and 4th floors of the whey processing tower did not provide adequate shielding or screens to prevent other persons from being exposed to direct rays from the arc. The 2nd floor had a single screen and the 4th floor had 3 screens with large gaps between. NO ABATEMENT CERTIFICATION REQUIRED

1926.21(b)(2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. 29 CFR 1926.502(b)(2)(i): Midrails, when used, were not installed at a height midway between the top edge of the guardrail system and the walking working level: a) On or about 5/22/2024 at a construction project located at 7000 Route 16, Franklinville, New York; employees working on the 3rd floor of the Whey Processing Tower were working near a shaft that had a midrail that was only attached on one end. Employees were exposed to a fall hazard in excess of 30 feet. NO ABATEMENT CERTIFICATION REQUIRED

The tank was not protected from parking lot vehicle traffic. NO ABATEMENT CERTIFICATION REQUIRED
