29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  (a) West exterior of building, third level; On or about May 31, 2024, while working from a Genie S-40 aerial lift, an employee was exposed to falls of approximately 25 feet without the protection of a personal fall arrest system.

29 CFR  1926.502(d)(6)(ii):  A snaphook not of the locking type was engaged (i) directly to webbing, rope or wire rope; (ii) to each other (iii) to a Dee-ring to which another snaphook or other connector is attached;(iv) to a horizontal lifeline; or (v) to any object which is incompatibly shaped or dimensioned in relation to the snaphook such that unintentional disengagement could occur by the connected object being able to depress the snaphook keeper and release itself:  (a) West exterior of building, third level; On or about May 31, 2024, while using a Genie S-40 aerial lift as an anchor point, an employee was exposed to falls of approximately 25 feet due to incompatible snaphooks for a 6-foot Guardian lanyard and a 50-foot Guardian lifeline rope attached to each other as part of the fall arrest system for the employee.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:  (a) West exterior of building, third level; On or about May 31, 2024, while using a Genie S-40 aerial lift as an anchor point and working outside the basket on a narrow section of roof, an employee was exposed to free falls of approximately 8 to 12 feet due to a 6-foot lanyard being attached to an additional section of rope approximately 2.5 feet long.  The employee's D-ring attachment point on the harness was above the anchor point on the Genie S-40 basket.
