29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. On or about June 7, 2024, in the facility, an employee performing shredding, was exposed to continuous noise levels at 97.6 % of the permissible daily dose level when measured with an 80 dba threshold, or an average equivalent sound level of the approximately 89.8 dba for the 390 minutes sampling time. b. On or about June 7, 2024, in the facility, an employee performing shredding, was exposed to continuous noise levels at 558.4 % of the permissible daily dose level when measured with an 80 dba threshold, or an average equivalent sound level of the approximately 102.4 dba for the 393 minutes sampling time. c. On or about June 7, 2024, in the facility, an employee performing shredding, was exposed to continuous noise levels at 95 % of the permissible daily dose level when measured with an 80 dba threshold, or an average equivalent sound level of the approximately 89.6 dba for the 359 minutes sampling time. d. On or about June 7, 2024, in the facility, an employee performing shredding, was exposed to continuous noise levels at 126.7 % of the permissible daily dose level when measured with an 80 dba threshold, or an average equivalent sound level of the approximately 91.7 dba for the 390 minutes sampling time. e. On or about June 7, 2024, in the facility, an employee performing shredding, was exposed to continuous noise levels at 179.5% of the permissible daily dose level when measured with an 80 dba threshold, or an average equivalent sound level of the approximately 94.2 dba for the 397 minutes sampling time.
