29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; (ii) Communicate selection decisions to each affected employee; and, (iii) Select PPE that properly fits each affected employee. On or about May 30, 2024, employees involved in the sterilization of the new compounding room at the Regional West Medical Center located at 4021 Avenue B, Scottsbluff, Nebraska, were exposed to chemical conjunctivitis hazards while using Peridox RTU, in that the employer had not effectively evaluated the work area through a formal hazard analysis process prior employee exposure. Specifically, the employees were cleaning the new compounding room with Peridox RTU without adequate protection and received optical burns.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazards in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: On or about May 30, 2024, employees involved in the sterilization of the new compounding room at the Regional West Medical Center located at 4021 Avenue B, Scottsbluff, Nebraska, were exposed to inhalation hazards while using Peridox RTU, in that the employer had not evaluated the new room to determine if respiratory hazards existed. Specifically, the employees were cleaning the new compounding room with Peridox RTU without adequate protection and received inhalation burns.
