29 CFR 1926.602(c)(1)(vi): All industrial trucks in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: On or about May 28, 2024, employees were exposed to struck by and crush by hazards when a JCB 508-66 telescopic handler was not operated in accordance with ANSI B56.1-1969, section 602, subparagraph E, when it was left unattended with its load engaging means in the air, loaded with a custom-made trash box containing roofing material. Paragraph E of the previously mentioned ANSI standard requires that the load engaging means of a powered industrial truck shall be fully lowered when left unattended.

29 CFR 1926.602(d): All employees utilizing powered industrial truck were not provided with operator training: On or about May 28, 2024, employees were exposed to struck by and crush by hazards when a JCB 508-66 telescopic handler was not operated by an employee who had received adequate training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 29 CFR 1910.178(l) of this chapter.
