29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a. On or about 3 June 2024, at Road 191 Km. 9.3, El Yunque, Rio Grande, PR. At a road construction site, a heavy equipment operator engaged in a road terrain stabilization operation with an excavator was not trained in the recognition on the hazards related to excavators, falls, excavations, cave-ins and collapses and the procedures to control or minimize those hazards. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.

On or about 3 June 2024, at Road 191 Km. 9.3, El Yunque, Rio Grande, PR. At a road construction site, a heavy equipment operator engaged in a road terrain stabilization operation with a CAT excavator was not removed from the work area, on a rainy day, exposing him to a fall from a cliff. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.
