29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a) Fabrication Shop: On or about June 3, 2024, and at times prior, employees were exposed to respiratory hazards, in that the employer does not provide information contained in Appendix D for the 3M Particulate Respirator N95 8210 given to employees on a voluntary basis when performing assigned work duties.

29 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).  a) Fabrication Shop: On or about June 3, 2024, and at times prior, employees were exposed to respiratory hazards, in that the employer did not establish and implement elements of a written program such as ensuring employees are medically able to use the respirator provided for voluntary use when performing assigned work duties.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a) Fabrication Shop: On or about June 3, 2024, and at times prior, the employer exposed to employees to struck-by hazards, in that forklift training was not provided to employee who are required to operate the forklifts during the fabrication process.
