29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the Sheet Metal Shop, on or about June 6, 2024 - The employer failed to administer a continuing hearing conservation program, including maintaining an audiometric testing program, when Sheet Metal Worker's noise exposures exceeded a dose of fifty percent while assembling duct work.

29 CFR 1910.95(g)(5)(ii): Where mobile test vans were used to meet the audiometric testing obligation, the employer did not obtain a valid baseline audiogram within 1 year of an employee's first exposure at or above the action level: a) In the Sheet Metal Shop, on or about June 6, 2024 - The employer did not obtain a valid baseline audiogram within 1 year of a Sheet Metal Worker's first exposure to noise above the action level. The Sheet Metal Worker has been assembling duct work for 3 years and was exposed to noise at an 8-hr TWA of 89.3 decibels on the A-scale, or equivalently a dose of 91.2%, during a 485 minute sampling period on July 25, 2024, while assembling duct work.

29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels: a) In the Sheet Metal Shop, on or about June 6, 2024 - A Sheet Metal Worker received a baseline audiogram on January 17, 2017. The employer did not obtain an annual audiogram for the Sheet Metal Worker who was exposed to noise above the action level while assembling duct work. The Sheet Metal Worker was exposed to noise at an 8-hr TWA of 87.7 decibels on the A-scale, or equivalently a dose of 72.9%, during a 478 minute sampling period on July 25, 2024, while assembling duct work.
