29 CFR 1926.1153(c)(1)(xii): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the handheld grinders for uses other than mortar removal task on Table 1, unless the employer assessed and limited the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: On or about June 6, 2024, an employee was engaged in grinding on a concrete door frame and the employer did not assess and limit the employee's exposure to respirable crystalline silica in accordance with paragraph (d) of this section, nor did the employer implement engineering controls and work practices including but not limited to the use of a grinder equipped with commercially available shroud and dust collection system.
