29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   a) Bottling line- On or about 06/06/24, and at times prior, the employer exposed employees to chemical hazards in that, the employer failed to develop a written hazard communication program when employees were working with hazardous chemicals such as, but not limited to, CA-400(corrosive), Ozone(respiratory hazards), and Perasan A (aka Proxy) (corrosive, oxidizer).

29 CFR 1910.132(d)(2):The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment:  a) Bottling line- On or about 06/06/24, and at times prior, employer exposed employees to chemical hazards in that, the employer failed to ensure that workplace hazard assessment was provided through a written certification for the hazards associated with sanitation operations while employees were working with chemicals such as but not limited to CA-400(corrosive), Ozone(respiratory hazards), and Perasan A (aka Proxy) (corrosive, oxidizer).

29 CFR  1910.134(c)(2)(i): When the employer determined that any voluntary respirator use was permissible, the employer did not provide the respirator users with the information in Appendix D of this section ("Information for Employees Using Respirator When Not Required Under the Standard"):  a) Bottling line - On or about 06/06/2024 and at times prior, the employer exposed employees to respiratory hazards in that, the employer failed to ensure that employees were provide with the safety information contained in Appendix D  of respiratory protection program prior to initial use of respirators when employees were using 3M Half-mask respirators voluntarily while working with chemicals such as CA-400(corrosive), and Perasan A (aka Proxy) (corrosive, oxidizer).
