29 CFR 1910.178(o)(1):The employer did not ensure that only stable or safely arranged loads were handled: On or about June 4, 2024, and at times prior, employees were exposed to crush-by and injury hazards due to the warehouse's forklift potentially tipping. Employees were using a Nissan LP Industrial Truck No. A00583742 (model variation #: MAP1F2A25LV) to lift a ramp with broken hydraulics. The weight of the ramp was unknown to the employees. The employer failed to ensure employees were not being exposed to unstable forklift loading practices.

29 CFR 1910.178(q)(7):Industrial trucks were being placed in services after the examination showed condition(s) adversely affecting the safety of the vehicle: a) Employees were exposed to crush-by hazards due to forklifts not being serviced. The employer failed to ensure the Nissan LP Industrial Truck No. A00583742 (model variation number: MAP1F2A25LV) was placed out of service until maintenance on the industrial truck occurred. The daily forklift checklists stated the tires needed repaired and the hydraulics on the ramp needed repaired for at least three months. These items were not fixed and the assistant manager notified upper management several times.
