OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties: a) On or about and at times prior to June 5, 2024, employees were exposed to the hazard of high heat from direct sun while performing their job duties, including framing, installing rebar and pouring concrete during their construction work. The National Weather Service had issued a heat advisory. An employee exhibiting signs of heat stress had a core temperature of 108.7F and passed away from heat stroke.
