29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition: (a) On or about June 1, 2024 and times prior, at or near 16105 32nd Street NW in East Fairview, North Dakota, employees of sand hauling companies loading at the facility were allowed to utilize a 12 foot high platform which was missing a safety gate.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) On or about June 1, 2024 and times prior, at or near 16105 32nd Street NW in East Fairview, North Dakota, employees of sand hauling companies loading at the facility were allowed to utilize a damaged platform which was also missing a gate, to access the top of their sand cans to open and close the hatches, exposing them to fall hazards of over four feet.
