29 CFR 1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. 1625 Emily Dr, Clarksburg, WV: On or about June 7, 2024 an employee utilized a JLG articulating boom lift to transfer materials onto the roof, approximately 16 feet 6 inches above grade. The employee was not using fall protection while working from the basket of the lift.

29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. 1625 Emily Dr, Clarksburg, WV: On or about June 7, 2024, an employee was moving materials on the roof of a one-story commercial property. The employee was not using a personal fall arrest system or a fall protection system exposing them to falls of up to approximately 16 feet 6 inches to the ground.
