29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: At the jobsite located at 5825 Marty Street, Overland Park, Kansas, an employee was exposed to struck-by and engulfment hazards. The employee was observed climbing out of a trench that measured approximately 9 feet deep, approximately 7 feet long and approximately 3 feet wide without adequate shoring, sloping or benching as a means of protection against trench collapse.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. At the jobsite located at 5825 Marty Street, Overland Park, Kansas; employees using a portable fiberglass ladder for access and egress of an open trench were exposed to slip and fall hazards into the trench. The side rails did not extend at least 3 feet above the upper landing surface. The 8 foot fiberglass ladder did not reach the upper landing surface while being used in a 9 foot deep trench.
