29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Production area - On or about 6/5/2024, an employee hand cutting stone near a diamond saw was exposed to continuous noise dose of 77.7%, or an equivalent of 88.2 dBA that exceed an 8-hour time-weighted average of 85 dBA. The employer failed to implement a hearing conservation program and include all employees exposed to noise levels at or above action level of an 8-hour Time Weighted Average (TWA) of 85dBA. The sampling was performed for 331 minutes during one shift on 6/5/2024; exposure calculations included a zero increment for the 149 minutes not sampled.

29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) Production area - On or about 6/5/2024, and at times prior to, employees were exposed to chemical hazards in that, the employer failed to develop and maintain a written hazard communication program when employees were working with hazardous chemicals such as, but not limited to, Pull-Out Premium Spot Cleaner and granite stone containing silica.
