29 CFR 1910.178(m)(5)(iii):When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. a.) On or about June 7, 2024, the employer failed to ensure that employees set the parking brake prior to dismounting the forklift, in that the Moffett M8 forklift's interlocking seatbelt safety feature was bypassed, and the manual parking brake was not engaged, exposing employees to crushed-by hazards.

29 CFR 1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a.) On or about June 7, 2024, Keim Lumber Company failed to ensure that required daily examinations of Moffett forklifts were conducted, thereby exposing employees to struck-by and crushed-by hazards. Employees did not remove the forklifts from the back of flatbed trucks to perform thorough inspections that could reveal adverse conditions affecting the safety of the vehicle. b.) On or about June 30, 2024, Keim Lumber Company failed to ensure that required daily examinations of Moffett forklifts were conducted, thereby exposing employees to struck-by and crushed-by hazards. Employees did not remove the forklifts from the back of flatbed trucks to perform thorough inspections that could reveal adverse conditions affecting the safety of the vehicle

On or about June 7, 2024, Keim Lumber Company failed to ensure that employees were adequately trained to conduct the required daily inspections of Moffett forklifts operators manual according to the manufacturer's guidelines in that employees were only trained to perform visual inspections while the forklifts were attached to the back of flatbed trucks, secured for transit.
