29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) On or about May 31, 2024, the controlling employer did not ensure frequent and regular safety inspections of the popcorn ceiling scraping operation were performed by a competent person. This work operation required subcontracted employees to access and frequently move a Bil-Jax mobile scaffolding set that was not inspected before use nor constructed by a qualified person to prevent tipping or collapse. This condition exposed subcontracted employees to scaffolding collapse and associated fall and struck-by injuries.

29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1): a) On or about May 31, 2024, and at times prior, the controlling employer and building owner, did not determine the presence, location and quantity of presumed asbestos-containing material in popcorn ceiling material before subcontracted employees began ceiling scraping operations in the salon area. This condition potentially exposed subcontracted employees to asbestos fibers and respiratory injury.
