29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity: a) On or about May 31, 2024, the creating employer, SNR Contractors and Associates, Inc., did not ensure the Bil-Jax mobile scaffolding equipment used by subcontracted employees was inspected for defects by a competent person before the work shift. Subcontracted employees were required to use the Bil-Jax mobile scaffolding to reach popcorn ceiling material to be scraped in the Salon Area and were injured during this mobile work operation due to mobile scaffold tipping, collapse, and separation upon ground impact. This condition exposed subcontracted employees to scaffolding collapse and associated fall and struck-by injuries.

29 CFR 1926.452(c)(3): Frames and panels were not joined together vertically by coupling or stacking pins or equivalent means: a) On or about May 31, 2024, the creating employer, SNR Contractors and Associates, Inc., did not ensure all vertical frame couplings that joined the two-part Bil-Jax mobile scaffolding set used by subcontracted employees, were secured with stacking pins. Subcontracted employees were required to use the Bil-Jax mobile scaffolding to reach popcorn ceiling material to be scraped in the Salon Area and were injured during this mobile work operation due to mobile scaffold tipping, collapse, and separation upon ground impact. This condition exposed subcontracted employees to scaffolding collapse and associated fall and struck-by injuries.

29 CFR 1926.1101(k)(3)(i): Before work in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM) was begun; the employer did not identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of this section: a) On or about May 31, 2024, and at times prior, the creating employer, SNR Contractors and Associates, Inc., did not identify for their subcontractor, Jalico Construction, LLC, the presence, location, and quantity of ACM, and/or PACM, when employees were required to scrape and remove popcorn ceiling texturing in the salon area of the building that was constructed in 1969. This condition potentially exposed employees to potential respiratory injury from asbestos fibers.
