29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Master Countertops Artisans in Marble & Granite in Chester Inc. located at or near 75 West 9th Street, Chester, PA 19013 - The employer did not administer a continuing effective hearing conservation program for employees engaged in stone cutting and finishing activities and exposed to continuous noise levels equivalent to 37.4%, 106.9%, and 136.9% of the allowable 50% dose for an 8 hour time-weighted average (TWA). These exposures were equivalent to an 8 hour TWA of 82.9 dBA, 90.4 dBA, and 92.2 dBA respectively, exceeding the OSHA Action Level of 85.0 dBA for an 8 hour TWA. Sampling times were 379, 378, and 389 minutes, respectively. Zero exposures were assumed for all unsampled time periods. Violation noted on September 24, 2024.
