Perry St Napoleon, OH 43612. The employer did not ensure that employees were protected from chemical hazards by developing and implementing a Hazard Communication program. Employees dispensing and handling Marathon Petroleum #2 Diesel as a solvent to clean out dump beds, paver trucks, tools, and footwear without the benefit of Hazard Communication program were exposed to hazards such as but not limited to fires and skin/respiratory irritations.

29 CFR 1926.20(b)(4):The employer did not ensure that the employee(s) required to operate equipment and machinery was qualified by training: a) Buck Bros Asphalt Paving & Concrete LLC; on or about June 05, 2024, at the site address of 1036 S. Perry St Napoleon, OH 43612. The employer failed to ensure employees tasked with operation of the Caterpillar 299D3 skid steer were adequately trained on the manufacturer's instructions and warnings prior to use. As a result, the operating employee as well as other employees performing job duties near the equipment being operated were exposed to hazards such as, but not limited to struck by hazards.
