29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a) The sidewalk located directly in front of the excavation at 9 Sydney Street, Dorchester, MA. (b) The driveway located between the excavation at 9 Sydney Street, Dorchester, MA and the residential property next door located at 11 Sydney Street, Dorchester, MA. (c) The area to the right side of the excavation at 9 Sydney Street, Dorchester, MA where the Porta potty is located. LOCATION: 9 Sydney Street, Dorchester, MA On or about June 3, 2024, employees were exposed to struck-by hazards while working within the excavation, where the employer did not ensure that a proper support system was in place to protect employees from the possible collapse of surrounding paved and sidewalk areas.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). LOCATION: 9 Sydney Street, Dorchester, MA On or about June 3, 2024, employees were exposed to struck-by hazards while working in the excavation, where the employer did not have an adequate protective system in place. The employer placed road plates in an area within the excavation to serve as a protective system, however, road plates are not engineered for that use.
