29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. (a) Imperial Construction LLC, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected: Citation 1, Item 1 a serious violation of 29 CFR 1926.502(d)(17) with an abatement date of August 20, 2024. Citation 2, Item 1 a repeat violation of 29 CFR 1926.503(a)(1) with an abatement date of September 3, 2024. Citation 2, item 2 a repeat violation of 29 CFR 1926.1053(b)(1) with an abatement date of August 20, 2024. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head. (a) On or about June 12, 2024, at 4482 Prairie Ridge Drive, Hubertus, WI 53033, the employer did not ensure employees installing a roof on a new construction residential home were properly wearing a full body harness that had a lifeline connected to the back dorsal D-Ring. Employees connected the lifeline to the front D-Ring located on the belt portion of the body harness, exposing employees to a fall hazard of approximately 11 feet from roof to the ground below on the back (west) side of the home. Imperial Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1709897, citation number 1, item number 1 and was affirmed as a final order on January 23, 2024, with respect to a workplace located at 7876 E Stone Ridge Dr. Lannon, WI 53046.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. (a) On or about June 12, 2024, at 4482 Prairie Ridge Drive, Hubertus, WI 53033, the employer did not ensure that all employees that were installing a roof were trained to recognize fall hazards and how to implement fall protection methods, exposing employees to fall hazards. Imperial Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1709897, citation number 1, item number 2 and was affirmed as a final order on January 23, 2024, with respect to a workplace located at 7876 E Stone Ridge Dr. Lannon, WI 53046.
