29 CFR 1910.147(c)(1):  Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  a) On or about June 10, 2022, the employer did not have an energy control program that included specific energy isolation procedures, training for authorized, affected, and other employees, and periodic inspections of the procedures on an annual basis for equipment such as but not limited to; Colborne Pie Crust Machine.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:  Each employee was not required to: (1) turn off and shut down the machines, (2) physically locate and operate energy isolating devices in such a manner as to isolate the machine or equipment from the electric and pneumatic energy sources, (3) affix lockout or tagout devices to each energy-isolating device, (4) verify the effectiveness of energy isolation.  a) On or about June 13, 2024, on the Colborne dough divider, the machine operator performing servicing operations, did not lock out the electrical when performing tasks such as cleaning the belts, brick portioner and flour wheel.   Phillips Homemade LLC DBA Mehaffies Pies was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(1), which was contained in OSHA inspection number 1602693, citation number 1, item number 1b and was affirmed as a final order on October 4, 2022, with respect to a workplace located at 3013 Linden Avenue, DAYTON, OH 45410.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a) On or about June 13, 2024, the employer did not ensure that the Colborne machine was guarded to prevent employees from getting caught in the rotating dough baller (dough divider).   b) On or about June 13, 2024, the employer did not ensure that the Colborne machine was guarded to prevent employees from getting caught in the plat former.  c) On or about June 13, 2024, the employer did not ensure that the Colborne machine was guarded to prevent employees from getting caught in the rotating corrugated wheel, in that the guard in place was able to be removed without any tools.   Phillips Homemade LLC DBA Mehaffies Pies was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(1), which was contained in OSHA inspection number 1602693, citation number 1, item number 2 and was affirmed as a final order on October 4, 2022, with respect to a workplace located at 3013 Linden Avenue, DAYTON, OH 45410.
