OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards. On or about 06/12/24, an employee was exposed to a crushing hazard while operating the HAMM HD-10C Mini Roller, that had the Seat Contact Switch removed and Seatbelt removed.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing hazards. On or about 06/12/24, employees did not inspect the HAMM DC-10C Roller to ensure the Operators Seat Safety Device was present and that the roller had a seatbelt.
