29 CFR  1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use:  (Construction Reference:  1926.103)  On June 13, 2024, at a worksite located on N Lilas Drive between W College Avenue and W College Service Road in Appleton, WI; the employer did not implement their written respirator protection program when respiratory protection was necessary to protect the health of an employee who had been operating a dowel drilling rig for concrete.  All provisions of 29 CFR 1910.134 (c) through (m) must be covered in a respiratory protection program. Key elements include, but are not limited to the following:  1) Medical clearances for respirator use 2) Fit testing 3) Employee training on respirator use, maintenance, care, and limitation 4) Recordkeeping 5) Program annual review

The training must be comprehensive, understandable, and recur annually, and more often if necessary: (Construction Reference:  1926.103)  On June 13, 2024, at a worksite located on N Lilas Drive between W College Avenue and W College Service Road in Appleton, WI; the employer did not provide training to each employee that was required to wear a half-face tight-fitting respirator when respiratory protection was necessary to protect the health of the employee who had been operating a dowel drilling rig for concrete. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  On June 13, 2024, at a worksite located on N Lilas Drive between W College Avenue and W College Service Road in Appleton, WI; the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, "(viii) Dowel drillings rig for concrete". The dowel drilling rig was not equipped with a shroud around the drill bit with a dust collection system. The employee operating the equipment was not fit tested for a respirator with an assigned protection factor (APF) of at least 10.  The Al Dix Concrete Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1153(c)(1), which was contained in OSHA inspection number 1556082, citation number 1, item number 1a and was affirmed as a final order on January 6, 2022 with respect to a workplace located at 1210 Ceape Ave, Oshkosh, WI 54901.
