29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) On or about December 18, 2024, at the worksite, 53 Highland Avenue, Binghamton, NY 13905: The employer failed to provide abatement certification for citation 1-3 identified in the inspection of this workplace. An abatement demand letter was sent to the employer on December 3, 2024.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a)  On or about June 13, 2024, at the worksite, 53 Highland Avenue, Binghamton, NY 13905:  Employees engaged in residential roofing activities, on 9:12 pitch roof, were not protected from falling by use of personal fall arrests, safety net systems, or guardrail systems.  The employees were exposed to fall hazards at a height of 17 feet.

29 CFR  1926.502(d)(17):  The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:  a) On or about June 13, 2024, at the worksite, 53 Highland Avenue, Binghamton, NY 13905: employees using personal fall arrest systems in residential roofing activities had the attachment point at the waist on positioning belts rather than the center of the back on the harness.  The employees were exposed to 17 foot fall hazards.
