29 CFR 1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated; On or about June 14, 2024 the employer did not ensure that employees operating and working within the confines of an aerial lift were utilizing personal fall arrest systems (harness and lanyard) while doing such. Employees were utilizing the aerial lift to perform work on the overhang area of the facility. Employees would exit the aerial lift to gain access to the roof area.

29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about June 14, 2024, the employer did not ensure that employees working from the roof area of the pump station overhang were protected from falling to the level below. Employees were tasked with installation of lighting and electrical components while working from this elevated height of approximately 25 feet.
