On or about June 11, 2024 employee(s) engaged in masonry construction work, including operator(s) of hand-held power saw(s), were exposed to the hazard of crystalline silica inhalation due to the employer's failure to implement engineering controls prescribed in Table-1 for control of dust. Employee(s) used a STIHL TS-420 portable power saw without integrated water delivery system for continuously feeding water to the blade while cutting bricks.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: a) 265 Morris Ave. Springfield, NJ 07081. On or about June 11, 2024, employee(s) including operator(s) of hand-held power saw and other laborer(s) performing masonry work, were exposed to the hazard of crystalline silica inhalation due to the employer's failure to fully and properly implement dust control method(s) prescribed for task(s) in Table-1. Employee(s) used a STIHL TS-420 portable power saw without integrated water delivery system for continuously feeding water to the blade while cutting bricks. Where the control measures prescribed in Table-1 were not implemented, the employer did not assess employees' exposure to crystalline silica through air monitoring.
