OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a struck-by and crushing hazard from a steel I-beam whaler that was cut free from a shaft cave-in support system. Worksite: On or about June 17, 2024, an employee was exposed to struck-by and caught between type hazards when the final torch cut of an unsupported I-beam was made causing the beam to strike the employee and pin him between the beam and a water pipe.

Worksite: On or about June 17, 2024, the employer did not ensure that a steel chain that was used to hoist 1500 pound steel I-beams from an excavation and above an employee was equipped with an identification tag indicating the chain's size, grade, rated capacity, and manufacturer.
