29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   At the jobsite located at 13205 W. 21st St. Ct.  Wichita, Kansas, employees performing concrete finishing and dry cutting concrete activities were exposed to hazardous chemicals including but not limited to Respirable Crystalline Silica, which is a skin irritant, can cause serious eye damage, respiratory irritation, and may cause cancer without being provided with information and training on how to recognize, avoid and/or eliminate the hazards associated with Respirable Crystalline Silica.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  At the jobsite located at 13205 W. 21st St. Ct.  Wichita, Kansas, employee(s) performing concrete finishing and dry cutting concrete activities utilizing Husqvarna X-TORQ circular saw were exposed to struck-by hazards of flying particles in that eye protection was not utilized.

29 CFR 1926.1153(c)(1):29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  At the jobsite located at 13205 W. 21st St. Ct. Wichita, Kansas, employees engaged in concrete finishing and dry cutting on concrete, were exposed to silica hazards. The employer failed to implement engineering and work practice controls as outlined in Table 1 to reduce employee exposure to silica dust.

Wichita, Kansas, employees performing concrete finishing and dry cutting concrete activities were exposed to Respirable Crystalline Silica hazards in that the employer had not established and implemented a written exposure control program. Employees were exposed to Respirable Crystalline Silica when performing concrete finishing and dry cutting operations.
