29 CFR  1910.146(d)(5)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not evaluate permit space conditions when entry operations were conducted by testing conditions in the permit space to determine if acceptable entry conditions existed before entry was authorized to begin.   a) On or about June 20, 2024, at the worksite above, an employee was required to enter permit required confined space.  The employee did not evaluate permit space conditions by testing the permit space with a hazardous gas meter to ensure that the space was safe for entry.

29 CFR 1910.146(k)(1)(ii): The employer did not evaluate a prospective rescue service's ability, in terms of proficiency with rescue-related tasks and equipment, to function appropriately while rescuing entrants from the particular permit space or types of permit spaces identified:  a)  On or about June 20, 2024, at the worksite above, an employee was required to enter permit required confined spaces.  The employer designated the rescue service to include "911" or the local fire department, who had not been notified or evaluated to determine availability or resources, thereby exposing entrant employee to untimely and inadequate rescue.

29 CFR  1910.146(k)(3)(ii): An authorized entrant entered a permit space and did not have the other end of the retrieval line attached to a mechanical device or fixed point outside the permit space in such a manner that rescue could begin as soon as the rescuer becomes aware that rescue is necessary:  On or about June 20, 2024, at the worksite above, an employee was required to enter a permit required confined space. The entrant employee was not provided with a mechanical lifting device for use in the assistance of a non-entry rescue, thereby exposing the employee to the hazards associated with permit required confined spaces. The entrant was located approximately 40 feet from the top entry point of the water tower without being attached to a mechanical device for retrieval after becoming unresponsive.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:  a) On or about June 20, 2024, at the worksite above, an employee was required to perform attendant duties for an employee entering a permit required confined space.  The employer failed to ensure that all employees were trained and provided the opportunity to acquire the understanding, knowledge and skills necessary to perform assigned duties as an attendant while an employee entered water tower that is a permit required confined space.

29 CFR  1910.146(g)(4): The employer's certification of the training required by 29 CFR 1910.146(g)(1) through 29 CFR 1910.146(g)(3) did not contain each employee's name, the signatures or initials of the trainers, and the dates of the training:  a)  On or about June 20, 2024, an employee was required to perform entry into permit required confined spaces.  The employer failed to certify that the training required by (g)(1) through (g)(3) of this section had been accomplished.  Certification of the employee training documenting the employees name, signatures of the trainers and dates of training was not available as required.
