29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. In the Alternative: 29 CFR 1926.103: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter. On or about June 13, 2024, and at times prior thereto, employees spraying foam insulation were required to wear a full-face respirator. The employer did not implement a written respiratory protection program to include but not limited to the following: a) Ensuring employees were medically cleared to wear a respirator. b) Ensuring employees were fit tested on respirator worn. c) Training employees on the program.
