29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.       a) NGOC DUYEN Temple, 518 Prospect Avenue, Syracuse, NY  13208, accessing the upper roof, on or about 6/13/24: Workers climbed the guardrails of the adjacent scaffold to access the roof surface.

29 CFR  1926.1053(b)(22): Employees  using ladders were carrying objects or loads that could cause the employee to lose balance and fall:    a) NGOC DUYEN Temple, 518 Prospect Avenue, Syracuse, NY  13208, accessing the porch roof, on or about 6/13/24: Workers climbed an extension ladder while carrying a sheet of plywood onto the roof and then to another ladder.  b) NGOC DUYEN Temple, 518 Prospect Avenue, Syracuse, NY  13208, accessing the upper roof, on or about 6/13/24: Workers climbed an extension ladder while carrying a sheet of plywood onto the roof and then to another ladder.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) NGOC DUYEN Temple, 518 Prospect Avenue, Syracuse, NY  13208, on the roof, on or about 6/13/24: Workers were installing roofing materials onto a 14:12 pitch roof, with a 15 foot distance from the eave to the lower level, without being connected to available fall protection systems.  b) NGOC DUYEN Temple, 518 Prospect Avenue, Syracuse, NY  13208, on the porch roof, on or about 6/13/24: Workers were stripping material off,  and using as a point of access to the upper roof, a flat (low slope) porch roof, 17 feet from ground without fall protection of any kind.  Wilson Gulan was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(11), which was contained in OSHA inspection number 1708704, citation number 1, item number 1 and was affirmed as a final order on 5/21/24, with respect to a workplace located at 8280 60 Road, Baldwinsville, NY  13027.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) NGOC DUYEN Temple, 518 Prospect Avenue, Syracuse, NY  13208, accessing the porch roof, on or about 6/13/24: Workers were using an extension ladder to carry material to another ladder, where that ladder did not extend at least 3 feet above the upper landing.  b) NGOC DUYEN Temple, 518 Prospect Avenue, Syracuse, NY  13208, accessing the upper roof, on or about 6/13/24: Workers were using an extension ladder to carry material to workers on the upper roof, where that ladder did not extend at least 3 feet above the upper landing.  Wilson Gulan was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1708704, citation number 1, item number 1 and was affirmed as a final order on 5/21/24, with respect to a workplace located at 8280 60 Road, Baldwinsville, NY  13027.
