29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   (a)Heinemann Restoration, Inc at 335 Walnut Street, Yankton, SD 57078: On or about and at times prior to June 24, 2024 the employer did not ensure employees completed a medical evaluation to determine their ability to use a respirator before the employee was required to use the respirator in the workplace. This condition exposed employees to hazards related to use of respiratory protection.

29 CFR  1910.134(f)(2): The employer did not ensure employees using a tight-fitting facepiece respirator were fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  (a)Heinemann Restoration, Inc at 335 Walnut Street, Yankton, SD 57078: On or about and at times prior to June 24, 2024 the employer did not ensure employee using a tight-fitting facepiece respirator were fit tested prior to initial use of the respirator and at least annually thereafter.  Fit testing is performed to ensure respirators area able to provide individual employees with expected levels of protection.  Employees who inhale respirable crystalline silica are at an increased risk of developing serious disease including but not limited to; silicosis, lung cancer, chronic obstructive pulmonary disease and kidney cancer.

29 CFR  1910.134(g)(1)(i)(A):Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:   (a)Heinemann Restoration, Inc at 335 Walnut Street, Yankton, SD 57078: On or about and at times prior to June 24, 2024, the employer permitted employees to use respiratory protection with facial hair that came between the sealing surface of the facepiece and the face.  Ineffective sealing of a respirator to the users face can reduce mask effectiveness of removing respirable crystalline silica from the users breathing air.  Employees who inhale respirable crystalline silica are at an increased risk of developing serious disease including but not limited to; silicosis, lung cancer, chronic obstructive pulmonary disease and kidney cancer.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall protection system:  (a)Heinemann Restoration, Inc at 335 Walnut Street, Yankton, SD 57078: On or about and at times prior to June 24, 2024 the employer did not ensure an employee working on the stairway shaft area was protected from fall hazards in that an appropriate fall protection system was not implemented. This condition exposed employees to fall hazards greater than six feet.  (b)Heinemann Restoration, Inc at 335 Walnut Street, Yankton, SD 57078: On or about and at times prior to June 24, 2024 the employer did not ensure an employee working on the center roof section was protected from fall hazards in that an appropriate fall protection system was not implemented.  This condition exposed employees to fall hazards greater than six feet.
