29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about June 24, 2024, it was observed that employees engaged roofing activities for J.Y.L. Construction LLC at a residential construction site located at 504 East 4th Street, Fremont, Nebraska were exposed to fall hazards in that employees were roofing the home without fall protection while exposed to a fall hazard of approximately 11 feet, 4 inches as measured ground to eave.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about June 24, 2024, it was observed that employees engaged roofing activities for J.Y.L. Construction LLC at a residential construction site located at 504 East 4th Street, Fremont, Nebraska were exposed to fall hazards in that employees working from a surface approximately 11 feet, 4 inches above the next lower level were not trained in the recognition of fall hazards and use of fall protection.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  On or about June 24, 2024, it was observed that employees engaged roofing activities for J.Y.L. Construction LLC at a residential construction site located at 504 East 4th Street, Fremont, Nebraska were exposed to fall hazards in that the employer did not ensure the multipurpose aluminum ladder(s) employees used to access the roof on the front side of the home were extended at least 3 feet above the landing surface. Instances of improper ladder placement included but were not limited to:  i. Left ladder with less than approximately 1 foot extension above the upper landing surface and  ii. Right ladder with less than approximately 1 foot extension above the upper landing surface.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder:  On or about June 24, 2024, it was observed that employees performing roofing activities for J.Y.L Construction LLC at a residential construction site located at 504 East 4th Street, Fremont, Nebraska were exposed to fall hazards in that the employees accessed the roof on the font side of the home using multipurpose aluminum ladders that were incorrectly angled beyond the 4:1 ration as required per the standard.  Instances included but were not limited to:  i. Left ladder angle horizontal distance measured approximately 6.37 feet as measured from directly below the access point on the roof to the base of the ladder.  To meet the 4:1 ration requirement the base of the ladder should have been 3.25 feet. And  ii. Right ladder angle horizontal distance measured approximately 6.15 feet as measured from directly below the access point on the roof to the base of the ladder. To meet the 4:1 ration requirement the base of the ladder should have been 3.19 feet.
